1. Agreement to Terms
By accessing or using Growbit at growbit.oferltechsolutions.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service. The Service is operated by Ofer.L Tech Solutions ("we," "us," or "our").
2. Description of Service
Growbit is a web-based habit tracking application that allows users to create, track, and monitor personal habits. The Service includes features such as daily habit logging, streak tracking, push notifications, and weekly summary reports.
The Service is provided free of charge. We reserve the right to introduce paid features or change the pricing model in the future, with advance notice to existing users.
3. Account Registration
To use Growbit, you must create an account using a valid email address. By creating an account, you:
- Confirm that you are at least 13 years of age
- Agree to provide accurate and truthful information
- Confirm that you have read and agree to these Terms of Service and our Privacy Policy
- Accept responsibility for maintaining the security of your account and password
- Accept responsibility for all activity that occurs under your account
Account registration is the point at which your agreement to both these Terms and the Privacy Policy takes effect. You must notify us immediately at contact@oferltechsolutions.com if you believe your account has been compromised.
4. Acceptable Use
You agree to use Growbit only for its intended purpose — personal habit tracking. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Create accounts for others without their explicit consent
- Use automated tools or scripts to access the Service without our written permission
5. Your Content and Data
Your habit data belongs to you. The habits, check-ins, notes, and other content you create in Growbit ("Your Content") remain your property.
By using the Service, you grant us a limited, non-exclusive license to store and process Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and do not use it for any other purpose.
You are responsible for the accuracy and legality of Your Content. You may export or delete your data at any time by contacting us at contact@oferltechsolutions.com.
6. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what data we collect, why we collect it, the legal bases under which we process it (including contract performance, consent, and legitimate interest), and your rights over that data.
Where the Privacy Policy requires your specific consent for a particular data practice (such as push notifications or weekly emails), that consent is obtained separately and explicitly within the app — it is not implied by your agreement to these Terms.
7. Push Notifications and Emails
If you enable push notifications or weekly summary emails, you consent to receiving these communications from us. You may opt out at any time through your account settings. Disabling these features will not affect your ability to use the core Service.
8. Intellectual Property
The Growbit name, logo, design, and all software code (excluding Your Content) are the intellectual property of Ofer.L Tech Solutions. You may not copy, reproduce, modify, or distribute any part of the Service without our written permission.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any content you create within the Service or decisions you make based on your use of the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFER.L TECH SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim (or $10 USD if you have not made any payments).
11. Termination
You may stop using the Service at any time. You may request deletion of your account and all associated data by emailing contact@oferltechsolutions.com. We will process deletion requests within 30 days as described in our Privacy Policy.
We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have violated these Terms. Where practicable, we will give you reasonable notice before termination so you have an opportunity to export your data. In cases of serious violations (such as unauthorized access attempts, abuse, or illegal activity), we may suspend access immediately without prior notice.
Upon termination, your right to use the Service ceases immediately. We will retain and delete your personal data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes to our practices, legal requirements, or the Service itself.
For material changes — those that meaningfully affect your rights, obligations, or data processing — we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after that notice period constitutes acceptance of the updated Terms.
For minor changes (such as clarifications, typo corrections, or additions that do not reduce your rights), the updated Terms become effective upon publication and we will update the "Last updated" date.
If you do not agree with a material change, you may stop using the Service and request account deletion before the new Terms take effect.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Israel, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the competent courts of Israel.
